Since the complaint, attorneys for Narain and online porn peddler Internet Commerce Group have been seeking distribution rights for the film, looking to make the case an issue of federal copyright, not privacy.

They succeeded this week in moving the case to federal court on copyright grounds.

“We believe that Ms. Narain is entitled to exercise her copyright per federal statutes, and we hope that the court will clear the way for the tape to be released soon,” Sal Abbate, CEO of ICG, said in an official statement Monday.

ICG wants to distribute the tape through its HollywoodSexTapes.com website.

Narain is clearly hoping the video goes public, too, having recently appeared on Rita Cosby’s “Life & Direct” show on MSNBC, where she spent a good deal of her time arguing entitlement to the money-making potential of the Farrell sex tape.

“And I want Colin to get his fair share, too,” she stressed during the Nov. 22 interview.

If Narain and ICG succeed in federal court, the Farrell tape could be on shelves just in time for Christmas!

This year I celebrated 21 years as an HIV/AIDS Survivor - which in my book is something to be thankful.

I’m sure that many of you had no idea or knowledge that yesterday Sunday, November 20, was the 7th Annual Transgender Day of Remembrance. This is the day set aside to remember those that have gone before – and a fitting beginning to International Transgender Awareness Week. The Day of Remembrance was started by Gwen Smith after the unsolved November 1998 murder of Rita Hester in Boston.

On Thursday in New York City a street corner in Greenwich Village was named after Stonewall veteran and transgender activist Sylvia Rivera. If you do not know the significance of Rivera or Stonewall to your own daily life – you better not tell me because I’ll come to where ever you are and whoop you upside the head!

On June 28, 1969 Sylvia Rivera was one of the first protestors to throw a bottle at the police while they were raiding the Stonewall Inn Bar. She realized even then that this was the “turning point” in the LGBT Rights Movement. When Rivera was asked by the press why they were protesting she shot back, “Hell hath no fury like a Drag Queen scorned!” Her simple statement has since become a battle cry that is still used today by many in the struggle for LGBT Rights.

In 1970 Sylvia joined the Gay Activists Alliance in an effort to pass a gay rights bill in New York City. She was never one to be told, “No” by anyone. Rivera once went as far as scaling the City Hall building in dress and high heels to crash a meeting. That’s commitment.

As the years past the mainstream gay culture made her feel out of place at her own party. In 1995 when activists dropped transgender rights from the proposed gay rights bill to make it more acceptable Gay writer Michael Musto interviewed Rivera about the issue, “When things started getting more mainstream it was like, ‘We don’t need you no more."

Even though she, herself, was frequently homeless she co-founded Street Transvestite Action Revolutionaries (STAR) with Marsha P. Johnson, to provide temporary housing for others in the transgender community.

Melissa Sklarz, co-chair for the LGBT Committee of Community Board #2, said she acted on a friend's suggestion to name the street corner after Rivera. "In the past we did very somber events. But we wanted to start celebrating our lives rather than mourning our dead." When told of the decision Smith concurred, “I can't think of anyone who is more deserving. She and Marsha P. Johnson were really the mothers of the modern trans rights movement."

Mara Keisling, executive director of the National Center for Transgender Equality (NCTE), said Rivera is the first out transgender person to have a street named after her. Sklarz added the naming of the northeast corner of Christopher and Hudson streets after Rivera also had a political message worthy of its namesake. "Right now we're having trouble with the community in Greenwich Village as the residents protest the LGBT people who hang out there as destructive to their way of life.

We thought naming this corner after this iconic figure who once prowled here would remind everyone of the neighborhood's history.”

This type of in-your-face activism was something Rivera was well known for. Even as she lay dying in the hospital when local gay leaders stopped by the intensive care unit to ask her advice, she gathered up all the strength in her tiny frame still hooked up to monitors, IVs and a morphine pump and gave them hell for not being inclusive enough! She died a few hours later on February, 19, 2002, only 50 years old.

She was a unique lady for a unique time that now shall never be forgotten. Take the time to know your LGBT History - it's very important for yourself and all those who will come after us. This once again proves my theory, "If it weren't for a Drag Queen none of this would be possible."

After performing in several other stage musicals, Payn turned to television and film, with little lasting success. Perhaps his best-known film was The Italian Job (1969), in which he shared comic scenes with Coward. Payn lived with Coward in lavish homes in Switzerland and Jamaica, and he worked less and less during the 1960s -- a fact Coward commented on publicly. "He is, I fear, a born drifter," Coward said, according to the Telegraph newspaper. "I know his theatrical career has been a failure but there are other ploys to go after. He sleeps and sleeps and the days go by. I love him dearly forever…. and am happy to look after him for the rest of my life but he must do something."

Payn oversaw Coward's estate after his death and co-edited the playwright's diaries in 1982. In 1994 he wrote his autobiography, My Life with Noel Coward. "I loved the man totally," Payn said of Coward. "I realized that I wanted nothing more than to share my life with this remarkable man, to help and protect him as best I could. If I had to write my epitaph it would read 'Friend of Noel Coward.'"

2) MILDRED SHAY, ACTRESS, DEAD AT 94

"Hollywood's Pocket Venus" Mildred Shay has died at her daughter's home in Glendale, Calif., at age 94. The British resident who appeared in more than 30 films during the 1930s but was better known for her Hollywood scandals and escapades, recently suffered a stroke, the Los Angeles Times reported.

Columnist Walter Winchell nicknamed the 5-foot-2 actress "Hollywood's Pocket Venus" for her alleged casting couch adventures and affairs with some of movies' top stars. She was said to have fought off the advances of actors Errol Flynn and Johnny Weissmuller. Filmmaker Cecil B. De Mille reportedly fed her oysters with pearls still attached and her affair with Victor Mature made headlines. Shay had a number of small roles throughout her Hollywood career - most notably she dubbed Greta Garbo's voice in the 1932 Oscar-winning Grand Hotel.

After two failed marriages, she married British Army Capt. Geoffrey Steele in 1941 and their union lasted more than 45 years. Shay is survived by her daughter, Georgiana Steele.

3) SHEREE NORTH, FILM, STAGE AND TV STAR, DEAD AT 72

Film, stage and TV star Sheree North, best known for her roles on The Mary Tyler Moore Show and Seinfeld has died in Los Angeles at age 72.

The platinum blonde bombshell of 1950s Hollywood played Lou Grant's girlfriend, Charlene Maguire, in The Mary Tyler Moore Show and Kramer's mom, Babs, on Seinfeld. North was groomed by 20th Century Fox to be a substitute for the unreliable Marilyn Monroe -- and that is exactly what happened in 1955's How to Be Very, Very Popular, in which North out-danced and outshone Betty Grable, the L.A. Times said.

Among her film credits were the 1956 musical The Best Things in Life Are Free, 1973's The Outfit and The Shootist. Her many TV roles included The Virginian, The Big Valley, The Fugitive, Cannon, McMillan and Wife, Owen Marshall: Counselor at Law, Kojak, Hawaii Five-O, Barnaby Jones, Fantasy Island, The Golden Girls, and Murder, She Wrote. (Terrifying that I remember most of her appearances on most of these shows!) She is survived by her husband, Phillip Norman, two daughters and a grandchild.

4) JEAN CARSON, FILM AND TV ACTRESS, DEAD AT 82

Veteran film and TV actress Jean Carson has died in Palm Springs, Calif., from complications of a stroke at age 82. Carson, best known for her "Hello Doll!" greeting as fun girl Daphne on The Andy Griffith Show died Nov. 2, Daily Variety reported Tuesday.

The Charleston, W. Va., native began on Broadway in George S. Kaufman's Bravo and later appeared in Arthur Laurent's The Bird Cage, Anniversary Waltz and Two Blind Mice. Her TV appearances included The Red Buttons Show, The G.E. Theater, Wagon Train, The Untouchables, and The Twilight Zone episode "A Most Unusual Camera".

Her films included The Phoenix City Story, I Married a Monster from Outer Space (one of my all time Sci-Fi Camp Favorites!), Gunn, The Party and Fun with Dick and Jane (The original!). She remained active in Palm Springs area theater after retiring from the public eye. She is survived by two sons.
